This website is operated by pokesido. Throughout the site, the terms “we”, “us” and “our” refer to pokesido. The term, "Shopify Shop" refers to our online shop using Shopify, shop.pokesido.com.
Please read these terms of service carefully before requesting for commission services. If you do not agree to all the terms and conditions of this agreement, then you may not use the commission services provided through this site.
You can review the most current version of the terms of service on the site at any time. We reserve the right to update, change or replace any part of these terms of service.
This Terms of Service is in regard to art commissions made through this site, and purchases made on the Shopify Shop. Tattoo service related Terms and Conditions is found at venue.ink/@pokesido/page/terms-and-conditions.
Product/Service is provided through either this site using Stripe as our payment processor, or Shopify.com, or Etsy.com. For more information on Etsy's Buyer policy, please find it at www.etsy.com/legal/buyers/.
General Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service/Product without written permission by us.
Accuracy of Information
You agree to provide current, complete and accurate information necessary for all purchases made on this site or the Shopify Shop. You agree to promptly update your account and other information, including your email address, card details, and billing and/or shipping address, so that we can complete your transactions and contact you as needed.
Modification to Prices
Prices for our Products/Services are subject to change without notice. We reserve the right at any time to modify or discontinue the Products/Services without notice at any time.
Shipping and Duties
We are not responsible for lost mail, unless tracking is included in shipment.
Estimated date of delivery is not guaranteed. We are not responsible for delayed shipping times and delivery.
Customers are responsible for handling any duties and taxes incurred.
Copyright
The purchase of any physical product from the Shopify Shop does not provide the customer with any copyright interest or other intellectual property right in the product. Products purchased from the Shopify Shop are to be used for personal use only.
Personal Commission Requests
A personal commission request, otherwise known as an order, can be made on this site through the links provided in the products page.
Once an order has been placed and paid, a receipt of payment will be sent to the email address provided at checkout. A confirmation of order received email, otherwise known as confirmation email, will be sent shortly after, which will include instructions on how to proceed with the order. Said email will be sent by hi@pokesido.com.
It is the responsibility of the customer to provide accurate contact information and to contact us if the payment receipt and/or confirmation email has not been received.
When the confirmation email has been responded to, in which the customer provides the reference photo(s) and/or a written description of the vision for the commissioned artwork, the order is considered to be in progress. The completed digital artwork will be delivered through email 1-3 business days thereafter.
The completed artwork will be in .JPG or .JPEG format and will be available for download through email attachment in the delivery email. When multiple quntities of digital artworks are ordered, a Google Drive invite link will be sent along with the delivery email. If the customer does not have access to Google Drive, the completed artwork will be sent through email attachment.
It is the responsibility of the customer to contact us if the completed artwork has not been received within the aforementioned delivery time of 3 business days.
Personal Use
All rights belong to pokesido. The commissioned artwork available for purchase on the site is for personal use only, and shall not be used for profit. It is prohibited to reproduce, duplicate, copy, sell, resell or exploit the artwork or service. Putting personal commissioned work into any Artificial Intelligence model and/or Large Language Model is prohibited.
Commercial Commission Requests
Please contact hi@pokesido.com for commercial commission requests. This includes digital tattoo tokens. Additional fees apply for commercial rights.
Once a commission request has been received, we may accept your request and send a payment processing link. When payment has been made and received by us, we will send a receipt of payment along with a confirmation email.
When the customer responds to the confirmation email with reference photo(s) and/or a written description of the vision for the commission/service, the order is considered to be in progress. The delivery time of the completed work will be discussed and agreed upon by both parties. It is the responsibility of the customer to contact us if the completed work has not been delivered and received in the agreed upon time.
The completed artwork will be in the format requested by the customer and accepted by us.
Commercial Use
Intended usage of the artwork must be disclosed in the commission request. Commercial usage by the customer outside of the agreed upon terms may result in additional fees.
The customer must purchase exclusive usage rights, otherwise, we retain the right to use the completed artwork to showcase publicly.
With the exception of resizing and/or cropping, altering the artwork is prohibited unless otherwise agreed upon.
Putting commercial commissioned work into any Artificial Intelligence model and/or Large Language Model is prohibited.
Transfer of the commercial license is not permissible without our consent.
Termination
We reserve the right to terminate your use of the product and/or service for violating any of the prohibited uses.
Refunds and Cancellations
Cancellation and refunds are not available once an order is in progress. If a customer is unsatisfied with the commissioned artwork/service, we will provide options for remediation.
Privacy
Our Privacy Policy details how your information is collected, used and shared when you use our Services. By using our Services, you are also agreeing that we can process your information in the ways set out in the Privacy Policy.
